U.S. Environmental Protection Agency (EPA) – lead agency for National Environmental Policy Act
(NEPA) compliance. EPA is responsible for the selection and supervision of the third-party contractor
(ENSR) to assist in the preparation of the Draft and Final Supplemental Environmental Impact Statement
(SEIS). EPA has primary responsibility for ensuring the SEIS meets NEPA compliance requirements

U.S. Army Corps of Engineers (Corps) – cooperating agency for NEPA compliance. The Corps will
participate in the identification of significant issues, mitigation measures, and alternatives related
to the Corps’ NEPA and Clean Water Act Section 404 and Section 10 responsibilities and authorities.

Alaska Department of Natural Resources (ADNR)
– cooperating agency for NEPA compliance. ADNR
will participate in the identification of significant issues, mitigation measures, and alternatives
related to ADNR’s responsibilities and authorities under the Alaska Surface Coal Mining Control and
Reclamation Act (ASCMCRA) permitting process.

U.S. Fish and Wildlife Service (USFWS) – consulting agency for NEPA compliance. USFWS will
participate in the identification of significant issues and potential alternatives for inclusion in
the SEIS relative to its responsibilities and authorities under the Endangered Species Act (ESA).
USFWS will provide technical assistance and recommend means to avoid and minimize impacts to USFWS
trust resources or to compensate for impacts that cannot be avoided. USFWS will provide specific
comments on the Biological Assessment to facilitate ESA consultation. |
